Terms & Conditions

These Terms & Conditions govern access to and use of the Qemah Al Mustaqbal website, Qemah Messaging and any service that expressly refers to these Terms.

1. About Qemah Al Mustaqbal

Qemah Al Mustaqbal Marketing Management is a company licensed in Dubai, United Arab Emirates. We provide digital marketing services, including SEO, Google Ads, Meta Ads and website development, and we develop software services including Qemah Messaging.

2. Scope of these terms

These Terms apply to our website and Qemah software where they are referenced. Digital marketing, website development and other managed services may also be governed by a proposal, order form, statement of work or separate service agreement. If a signed service agreement conflicts with these Terms for that service, the signed agreement will control to the extent of the conflict.

3. Accounts and authorised users

Qemah Messaging is an invite-only service. We create or activate a customer account after Qemah approves the business and confirms payment for the agreed access period; the public cannot self-register. A person accepting on behalf of a business confirms that they are authorised to act for it. Business administrators may invite authorised staff where the service allows.

You must provide accurate information and keep account credentials secure. You are responsible for activity performed through your account by you and your authorised users. You must notify us promptly if you believe an account or credential has been compromised.

4. Qemah Messaging and third-party platforms

Qemah Messaging may connect with third-party services such as WhatsApp Business Platform and Meta services. Your use of those services remains subject to their own terms, policies, technical limits and availability. We do not control third-party approvals, restrictions, outages, account reviews or policy changes.

You must use Qemah Messaging in accordance with our Acceptable Use & Messaging Policy and all applicable laws and platform requirements.

5. Customer data and lawful use

You are responsible for ensuring that information you upload, import, connect or use through our services was obtained and is used lawfully. You must have the rights, permissions, notices and consents required for your intended use, including for marketing communications. For WhatsApp messages, follow our Acceptable Use & Messaging Policy.

Our handling of personal information is described in our Privacy Policy, including our Data Deletion instructions. Where we process personal data on behalf of a business customer, additional data-processing terms may apply.

6. Fees, billing and service changes

Fees, billing periods, included services, cancellation and refund terms, and payment terms are shown in the applicable plan, proposal, invoice, order form or service agreement. Unless otherwise agreed in writing, Qemah Messaging access is paid in advance by bank transfer; Qemah confirms receipt before activating or renewing access. There is no automatic renewal or recurring card debit.

Qemah Messaging subscription fees cover access to our software for the agreed period. WhatsApp messaging and other Meta platform charges are separate, are not included in our software fee, and are the customer’s responsibility through its Meta account or applicable billing provider. Advertising spend and other third-party charges are likewise separate unless expressly included in writing.

We may change plans, features or pricing prospectively. Material changes that affect an active paid service will be communicated where reasonably required.

7. Intellectual property

Qemah software, branding, interfaces, documentation, website content and underlying technology remain owned by Qemah Al Mustaqbal or the relevant rights holder unless expressly agreed otherwise. You retain ownership of content and data that you lawfully provide to us.

Website-development ownership, licences and handover terms may be set out separately in the relevant service agreement.

8. Prohibited conduct

You must not misuse our services, attempt unauthorised access, interfere with security or service operation, infringe third-party rights, distribute malicious material, conduct unlawful activity, or use Qemah Messaging for spam, deceptive communications or messaging without required permission.

9. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect users, systems or third parties; respond to legal or platform requirements; address non-payment; investigate suspected misuse; or prevent material breaches of these Terms or our Acceptable Use & Messaging Policy.

Where practical, we will provide notice and an opportunity to resolve the issue, except where immediate action is necessary.

When a paid Qemah Messaging period expires or access is suspended, sending and editing may be unavailable while permitted users retain read-only access where technically available. Non-payment alone does not automatically delete customer data. Requests to access, export or delete data are handled under our Privacy Policy and Data Deletion instructions.

10. Service availability and results

We aim to provide services professionally and with reasonable care, but online services and third-party platforms may experience interruptions, changes or technical failures. Digital marketing performance also depends on factors outside our control, including market conditions, competition, advertising platforms, budgets, offers, websites and customer sales processes.

Unless expressly agreed in writing, we do not guarantee specific rankings, leads, sales, advertising approvals, cost per lead, return on investment or uninterrupted availability.

11. Liability

To the maximum extent permitted by applicable law, neither party will be liable for indirect, incidental, special or consequential losses arising from use of the services. Any specific liability limits agreed in a signed service agreement or order form will apply to that service.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

12. Changes to these terms

We may update these Terms as our services, legal obligations or platform relationships change. The current version and effective date will be shown on this page. Where a change materially affects an active paid service, we will provide reasonable notice where required.

13. Governing law and contact

Unless a separate written agreement states otherwise, these Terms are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai, subject to any mandatory rights that apply.
